Terms of Service

Last updated: September 25, 2026

These Terms of Service (“Terms”) govern your use of the embarkAI Wallet (the “Wallet”) and the services embarkAI provides to operate it (together, the “Service”). By signing in to the Wallet, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

The Wallet is a self-custodial smart wallet. It is usually opened inside a website or application built by a third party (an “App”) that has integrated embarkAI. embarkAI provides the Wallet and the infrastructure behind it. Each App is operated by its own developer.

2. Eligibility

You may use the Service only if:

  • you are at least 18 years old, or the age of majority where you live if that is higher;
  • you are not a person or entity subject to sanctions, and you are not located in a country or region subject to comprehensive sanctions;
  • using the Service is lawful where you live.

3. Signing in

You sign in with an email address, a social account, a passkey or another method the Wallet offers. You are responsible for keeping these methods secure. Anyone who controls your sign-in method may be able to use your Wallet.

4. How your keys work

  • The key that controls your Wallet is never created or stored in one piece. It is split into two keyshares: one is kept on your device, the other is kept by embarkAI.
  • Both keyshares are needed to sign a transaction. embarkAI cannot sign or move your assets without you, and neither party can sign alone.
  • Because embarkAI holds one of the keyshares, signing requires the Service to be available. If the Service is unavailable, you may be temporarily unable to sign transactions.
  • If you lose the keyshare on your device and have no backup, access to the Wallet may be lost permanently. embarkAI cannot restore it for you. Use the backup options the Wallet offers.

5. Transactions

  • You are responsible for every transaction you approve. Check the details before you confirm.
  • Blockchain transactions are generally irreversible. We cannot cancel, reverse or refund them.
  • Network fees (“gas”) may apply. An App may pay them for you, but this is not guaranteed and may stop at any time.
  • We do not control blockchains, their validators, or the smart contracts you interact with.

6. Policies and limits

The Wallet can enforce rules on what it signs, such as spending limits and lists of allowed or blocked destinations. These rules may be set by you or by the App you use. A transaction that breaks any rule that applies to it is refused.

When you loosen or remove one of your own rules, the change takes effect only after a waiting period, currently 24 hours. This gives you time to cancel a change you did not make.

7. Third-party Apps

Apps are not operated by embarkAI. We are not responsible for their content, availability, smart contracts, fees or conduct. Their own terms and privacy policies apply to your use of them. An App’s developer may set rules that apply to your Wallet within that App.

8. Identity verification

We or an App may ask you to verify your identity through a third-party verification provider. We may limit, suspend or refuse the Service if you do not complete verification or if it fails.

9. Prohibited use

You agree not to use the Service to:

  • break any law, including anti-money-laundering and sanctions laws;
  • carry out or facilitate fraud, illegal activity, or the infringement of anyone’s rights;
  • interfere with, attack, or try to gain unauthorized access to the Service or to other users’ wallets;
  • reverse engineer the Service, except where the law allows it.

10. Suspension and termination

We may suspend or end your access to the Service, in whole or in part, if you break these Terms, if the law requires it, or if it is needed to protect the Service or its users. You can stop using the Service at any time. Suspension or termination does not transfer your assets to embarkAI.

11. Intellectual property

The Service, including its software, design and trademarks, belongs to embarkAI and its licensors. These Terms give you a limited, personal, non-transferable right to use the Service as intended. Open-source components of the Service are covered by their own licenses.

12. No advice

Nothing in the Service is financial, investment, legal or tax advice. You decide what to do with your assets.

13. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, to the maximum extent permitted by law. We do not promise that the Service will be uninterrupted, secure or free of errors.

14. Limitation of liability

To the maximum extent permitted by law, embarkAI is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of assets, profits or data, arising from your use of the Service, from Apps, from blockchains, or from the loss of your sign-in methods or your keyshare. Nothing in these Terms limits liability that cannot be limited by law.

15. Indemnity

You agree to compensate embarkAI for claims and losses that arise from your breach of these Terms or your misuse of the Service.

16. Privacy

To provide the Service we process personal data, such as your email address, your sign-in details and, where required, identity verification data. A separate Privacy Policy will describe this in detail.

17. Changes to these Terms

We may update these Terms. The date at the top of this page shows the current version. If a change is material, we will take reasonable steps to tell you before it takes effect. If you keep using the Service after that, you accept the updated Terms.

18. Contact
